Property relations between spouses are a central element in the relationship, and law plays an important role in shaping and regulating them. This book deals with the legal regulation of property relations between spouses. Many legal systems, including Israeli law, have transitioned from the separation of all assets to the model of joint ownership, a transition that highlights the trend in the Western world to go beyond individualistic thinking in many areas of family law.
The book combines theoretical discussion on rationales that are at the basis of marital property law and the principles of proper regulation of marital property and an in-depth analysis of policies for spousal property in Israel. Among other things discussed: the assets included in the collaboration, the ability to circumvent certain express or implied sharing agreements, the distinction between types of marriage, shared property management during the marriage, sharing duties, conflicts between rights under the rules of sharing the marital or rights of third parties such as creditors, earning capacity, alimony after divorce, compensation for loss of career and ability to exceed the equal distribution of marital property between spouses.
Some of the issues raised in the analysis of the existing law lead to recommendations for their amendment. In other cases, the book interprets the existing law in principle.
